As of 10/26 (sorry, I didn't catch the story when it originally ran), the judge has upheld the death sentence for Gregory McKnight.

I truly wish Judge Simmons had changed it back to life in prison. He ignored Emily Murray's family's request to change the sentence, plus he opened the door for endless appeals, including a request for a new trial. According to the Dispatch, "defense attorneys have said that Simmons did not have authority to reinstate the death-penalty charges without a new grand jury indictment or without new charges. The judge's decision to restart the case, defense attorney K. Robert Toy of Athens said, established grounds that could win McKnight a new trial."

I have a feeling this isn't over, but it will manage to fade into the background of the news coverage. I'll keep my eyes open for new information.
